PROPOSED MISCELLANEOUS ITEM OF BUSINESS

Department:   Department of Real Estate Management

Summary:  On 7/17/2013, the Board of Commissioners approved a Lease Agreement (“Master Lease”) with the Regional Transportation Authority (“RTA”), granting RTA the right to use and occupy certain premises located in the pedway of the George W. Dunne Cook County Administration Building located at 69 West Washington Street as a customer service and sales center by the RTA for its Reduced Fare Program. The term of the Master Lease expires on 8/31/2025, with an option to extend for an additional five-year term.

The RTA has requested permission to sublease all of the premises to the City of Chicago Board of Elections (CCBOE). The additional office space will allow the Chicago Board of Election Commissioners to provide its services to the taxpayers more efficiently.

The RTA will remain primarily liable for, and will not be released from, the full and faithful performance of all terms and conditions of the Master Lease, or any breach committed by Subtenant under the Sublease.  The County will be entitled to pursue all remedies available in the event of RTA’s breach of the Master Lease, without regard to the performance or nonperformance of the terms of the Sublease between the RTA and CCBOE.

Approval is respectfully requested for the County to execute and deliver the attached Consent to Sub Lease Agreement.
