Title: PROPOSED AMENDMENT TO FILE ID 16-1549 PROPOSED RESOLUTION SUPPORTING ILLINOIS HOUSE BILL NUMBER 4434 WHEREAS, Cook County is responsible for the provision of certain services, including police protection by the Cook County Sheriff, if a municipality within its borders fails to adopt a property tax levy; and WHEREAS, Illinois State Representative Anthony DeLuca has introduced House Bill Number 4434 that provides for the county clerk to extend a property tax rate from the year with the most recent property tax levy; and WHEREAS, the clerk's extension shall be equal to the lesser of 1) the rate extended for that municipal fund in the previously extended year; or 2) the maximum rate that would be permitted under law had a valid levy ordinance been adopted.; and NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners of Cook County supports House Bill Number 4434 and encourages the Illinois General Assembly to pass the bill and for Illinois Governor Bruce Rauner ...

PROPOSED RESOLUTION

 

SUPPORTING ILLINOIS HOUSE BILL NUMBER 4434

 

 

WHEREAS, Cook County is responsible for the provision of certain services, including police protection by the Cook County Sheriff, if a municipality within its borders fails to adopt a property tax levy; and

 

WHEREAS, Illinois State Representative Anthony DeLuca has introduced House Bill Number 4434 that provides for the county clerk to extend a property tax rate from the year with the most recent property tax levy; and

 

WHEREAS, the clerk’s extension shall be equal to the lesser of 1) the rate extended for that municipal fund in the previously extended year; or 2) the maximum rate that would be permitted under law had a valid levy ordinance been adopted.; and

 

NOW, THEREFORE, BE IT RESOLVED, that the Board of Commissioners of Cook County supports House Bill Number 4434 and encourages the Illinois General Assembly to pass the bill and for Illinois Governor Bruce Rauner to sign it; and requests that HB4434 be amended to limit its applicability to those situations where no action of any type is taken on a municipality’s property tax levy in tax year 2015 collected in 2016; and

 

BE IT FURTHER RESOLVED, that the amendment allow the county clerk’s extension to be equal to the lesser of 1) the tax levy extended for that municipal fund in the previously extended tax year; or 2) the maximum levy that would be permitted under law had a valid levy ordinance been adopted.

 

BE IT FURTHER RESOLVED, that the Board of Commissioners of Cook County supports an amended House Bill Number 4434 and encourages the Illinois General Assembly to pass the bill and for Illinois Governor Bruce Rauner to sign it; and

 

THEREFORE BE IT FURTHER RESOLVED that a suitable copy of this resolution be tendered to State Representative DeLuca, Illinois Speaker of the House Michael Madigan, Illinois Senate President John Cullerton and Illinois Governor Bruce Rauner.
