PROPOSED RESOLUTION

REQUESTING THE COOK COUNTY BOARD’S CRIMINAL JUSTICE COMMITTEE TO CONVENE A HEARING REGARDING THE RESPECTIVE AUTHORITY, RESPONSIBILITIES, AND INVESTIGATIVE OVERSIGHT PROCEDURES OF THE COOK COUNTY SHERIFF’S OFFICE AND THE OFFICE OF THE INDEPENDENT INSPECTOR GENERAL

WHEREAS, the Cook County Board of Commissioners recognizes the importance of transparency, accountability, fairness, and public confidence in the administration of County government and its public safety institutions; and

WHEREAS, the Cook County Sheriff’s Office is an independently elected office responsible for carrying out significant law enforcement, correctional, and public safety responsibilities under Illinois law; and

WHEREAS, the Cook County Office of the Independent Inspector General (OIIG) is established under County ordinance to promote integrity, accountability, and responsible government through the exercise of its legally authorized oversight and investigative functions; and

WHEREAS, both the Sheriff’s Office and the OIIG perform important public functions, and clarity regarding their respective legal authority, responsibilities, and procedures is essential to effective government operations; and

WHEREAS, questions have arisen concerning the scope of the OIIG’s authority to review certain investigations involving Sheriff’s Office personnel and the respective responsibilities of both offices in addressing allegations of misconduct; and

WHEREAS, the OIIG has identified and communicated recommendations concerning investigative procedures, including:

The identification, documentation, and appropriate consideration of allegations arising from complaints, video recordings, reports, and other available evidence;

The establishment and consistent application of procedures for informational complaints and external referrals, including appropriate management notification, documentation, and disposition;

The application of consistent investigative standards, including witness interviews, examination of relevant evidence, identification of potential subjects, and documentation of investigative findings and decisions; and

WHEREAS, differences in interpretation or implementation of these recommendations warrant further examination to better understand the legal, operational, and administrative considerations of the respective offices; and

WHEREAS, concerns have also been raised regarding the handling and disposition of certain complaints involving Sheriff’s Office personnel, including a reported incident involving allegations that an employee reported for duty while impaired and possessed an allegedly unlawful firearm; and

WHEREAS, the inclusion of such allegations in this Resolution is solely for the purpose of identifying matters appropriate for procedural review and shall not be construed as a determination that misconduct occurred or that any investigation was improperly conducted; and

WHEREAS, the OIIG has established a Public Safety Oversight Unit to address matters within its asserted oversight responsibilities, and questions concerning the unit’s legal authority, operational scope, coordination, and relationship with existing investigative functions warrant examination; and

WHEREAS, the OIIG has requested that the Cook County Board’s Criminal Justice Committee convene a public hearing to examine these matters; and

WHEREAS, the Cook County Board’s Criminal Justice Committee has an interest in ensuring that County public safety institutions operate within their respective legal authority and maintain appropriate standards of transparency, accountability, due process, and public trust; and

WHEREAS, a hearing would provide an appropriate forum for the Sheriff’s Office, the OIIG, and other relevant parties to present their respective positions, explain existing procedures, and identify opportunities for improved coordination and clarity; and

WHEREAS, the purpose of such a hearing is to gather information, clarify applicable legal and administrative responsibilities, and evaluate existing policies and procedures without prejudging the conduct, legal position, or conclusions of any individual or office.

NOW, THEREFORE, BE IT RESOLVED, that the Cook County Board of Commissioners requests that the Criminal Justice Committee convene a hearing for the following purposes:

1.                     Legal Authority and Jurisdiction: Examine the respective legal authority, jurisdiction, and responsibilities of the Cook County Sheriff’s Office and the OIIG under applicable Illinois law and Cook County ordinances.

2.                     Investigative Standards and Procedures: Review the policies, procedures, and standards used to receive, investigate, document, refer, and resolve complaints involving Sheriff’s Office personnel.

3.                      Recommendations and Responses: Examine the OIIG’s investigative recommendations and the Sheriff’s Office’s responses, including any legal, operational, or administrative considerations influencing their implementation.

4.                     Complaint Review and Disposition: Review the procedures followed in selected matters involving allegations of employee misconduct, including the reported impaired-and-armed employee incident, to determine whether existing policies provide appropriate standards of documentation, review, accountability, and due process.

5.                     Public Safety Oversight Unit: Examine the purpose, legal authority, responsibilities, and operational scope of the OIIG’s Public Safety Oversight Unit, including its relationship with existing Sheriff’s Office investigative and accountability functions.

6.                     Interagency Coordination: Identify opportunities to strengthen communication, coordination, and the appropriate exchange of information between the Sheriff’s Office and the OIIG while respecting their respective legal responsibilities.

7.                     Potential Improvements: Consider whether additional policy guidance, administrative procedures, interagency agreements, or legislative clarification may be appropriate to strengthen transparency, accountability, and public confidence.

BE IT FURTHER RESOLVED, that the Criminal Justice Committee shall conduct the hearing in an impartial manner, affording the Sheriff’s Office, the OIIG, and other invited participants a fair and reasonable opportunity to present information, respond to questions, and explain their respective positions; and

BE IT FURTHER RESOLVED, that the Committee shall invite testimony from the Cook County Sheriff, the Independent Inspector General, appropriate representatives of their respective offices, relevant legal and administrative experts, and other individuals whose participation may assist the Committee in fulfilling its oversight responsibilities; and

BE IT FURTHER RESOLVED, that the Committee shall conduct its proceedings in accordance with applicable law, including requirements concerning confidentiality, personnel privacy, due process, and the protection of ongoing investigations; and

BE IT FURTHER RESOLVED, that nothing in this Resolution shall be interpreted as a finding of misconduct, an endorsement or rejection of any disputed legal position, or an attempt to interfere with the lawful duties and independent authority of either office; and

BE IT FURTHER RESOLVED, that following the hearing, the Committee may consider appropriate recommendations concerning legislative clarification, administrative coordination, or improvements to investigative oversight procedures based upon the information presented; and

BE IT FURTHER RESOLVED, that the Clerk of the Board shall transmit a copy of this Resolution to the Chair of the Criminal Justice Committee, the Cook County Sheriff, and the Cook County Independent Inspector General.
